Terms & Conditions

1. Introduction & Acceptance

By placing a preorder for chickens through Deep South Soil ("we", "our", or "the Farm"), you ("customer") agree to these Terms & Conditions. These terms are intended to be straightforward and transparent, reflecting the realities of a small, seasonal farm operation.

We may update these Terms & Conditions from time to time. Continued use of our website or preorder form after any updates constitutes acceptance of the revised terms.

2. Ordering & Deposits

Preorders Required – All chickens are offered by preorder only. We raise a limited number of birds each season.

Deposit Amount – A $10 deposit per bird is required at the time of order to reserve your chickens.

Order Confirmation – Submitting an order form and deposit does not guarantee availability until your order is confirmed by us.

Deposit Purpose – Deposits help cover upfront costs such as chicks and feed and are applied toward the final purchase price.

3. Pricing & Payment

Each bird costs $20 total.

$10 deposit at signup

$10 balance due at pickup

Accepted Payment Methods – Venmo (Deep South Soil business account) or cash.

No Online Checkout – We do not process payments through the website.

4. Pickup Scheduling & Communication

Chickens are harvested seasonally, typically in Spring and Fall.

Customers will be notified of the expected harvest window and asked to confirm a pickup date.

We will send pickup reminders via email or text.

Pickup occurs at our farm off FM-751 near Wills Point, TX. Exact directions and times will be shared closer to harvest.

If you cannot attend your confirmed pickup, you may send a substitute. Please notify us in advance.

5. No-Show & Waitlist Policy

Because we raise a very limited number of birds, we cannot hold chickens beyond the confirmed pickup date.

If chickens are not picked up on the confirmed date and no prior arrangements have been made, the birds may be offered to customers on the waitlist.

Deposits are forfeited for no-show orders.

6. Refund & Cancellation Policy

Farm-Initiated Cancellations – If chickens do not reach harvest or otherwise do not survive to harvest, all deposits for those birds will be fully refunded.

Customer-Initiated Cancellations – Deposits are generally non-refundable, as birds are raised specifically for preorder customers.

Refund Method – Refunds will be issued via Venmo or cash, depending on the original payment method.

7. Seasonal Variability & Farm Risks

Farming involves natural variability. Harvest timing, growth rate, and final weights may vary due to weather, feed, and environmental conditions.

Expected harvest weights are typically approximately 4–6 pounds per bird, but no specific weight is guaranteed.

In the event of losses due to weather, predators, illness, or other factors beyond our control, deposits will be refunded as outlined above. No additional compensation is provided.

8. Live vs. Processed Chickens

Customers may choose to take chickens live, or have chickens processed by us at no additional charge.

We do not charge for processing and do not imply that processing is a paid service.

Chickens are provided fresh, never frozen.

Once chickens leave the farm, responsibility for proper handling, storage, and food safety transfers to the customer.

9. Waitlist

When demand exceeds availability, we maintain a waitlist.

Waitlisted customers will be contacted in order if birds become available due to cancellations or no-shows.

Deposits are not collected from waitlisted customers until availability is confirmed.

10. Communications

By placing an order, you agree that we may contact you regarding your order via email, text message, or phone call.

11. Governing Law

These Terms & Conditions are governed by the laws of the State of Texas.

These Terms & Conditions are designed to protect both our customers and the long-term sustainability of our small farm.
